1. Acceptance of Terms

By accessing or using Unlimited Patterns ("the Service", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Unlimited Patterns is a platform for creating, generating, and selling seamless patterns. Our services include:

AI-powered pattern generation
Pattern editing and customization tools
Marketplace for selling patterns
Integration with third-party platforms (Shopify, Printful, etc.)
Subscription-based access to features and credits

3. Accounts and Registration

3.1 Account Creation

To use certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. Notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

4. Subscription and Payments

4.1 Subscription Plans

We offer various subscription plans with different features and credit allowances. Details of current plans are available on our pricing page.

4.2 Payment Terms

Subscriptions are billed in advance on a monthly or annual basis
All payments are processed through LemonSqueezy
Prices are in USD unless otherwise stated
You are responsible for all applicable taxes

4.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are provided at our sole discretion, except where required by law.

4.4 Credits

AI generation credits are consumed when you use AI features. Credits do not expire while your subscription is active. If your subscription lapses, unused credits may be forfeited after a grace period.

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of patterns you create using our tools ("Your Content"). By uploading or creating content on our platform, you grant us a license to host, display, and process Your Content solely for the purpose of operating and improving the Service.

5.2 AI-Generated Content

Patterns generated using our AI tools are owned by you, subject to the following:

You may use AI-generated patterns for commercial purposes
You may not claim copyright over the underlying AI model or training data
AI-generated content is provided "as is" without warranties of originality
We do not guarantee that AI-generated patterns are free from similarity to existing works

5.3 Prohibited Content

You may not create, upload, or sell content that:

Infringes on intellectual property rights
Contains malware, viruses, or harmful code
Violates applicable laws or regulations
Contains hate speech, harassment, or discriminatory content
Contains sexually explicit or adult content
Promotes violence or illegal activities

5.4 Platform Content

All platform content, features, and functionality (excluding Your Content) are owned by Unlimited Patterns and protected by copyright, trademark, and other intellectual property laws.

6. Marketplace and Sales

6.1 Selling Patterns

When you list patterns for sale on our marketplace:

You set your own prices
You warrant that you have the right to sell the patterns
You agree to our revenue share model (as displayed at time of sale)
You are responsible for providing accurate descriptions

6.2 Platform Integrations

When you connect third-party platforms (Shopify, Printful, etc.):

You authorize us to sync your patterns to these platforms
You are bound by the terms of service of those platforms
We are not responsible for platform outages or changes
You may revoke access at any time through your settings

6.3 Payouts

Sellers receive payouts according to our payout schedule. You must provide valid payment information to receive payouts. We reserve the right to withhold payouts in case of disputes or suspected fraud.

7. License Terms for Buyers

7.1 Personal License

A Personal License grants you the right to:

Use the pattern for personal, non-commercial projects
Create physical items for personal use
Modify the pattern for personal use

7.2 Commercial License

A Commercial License grants you the right to:

Use the pattern for commercial projects
Sell physical products featuring the pattern
Use in client work
Subject to any quantity limitations specified

7.3 License Restrictions

Unless expressly permitted, you may not:

Resell or redistribute the digital pattern files
Use patterns in trademark or logo designs
Create competing products from the patterns
Use patterns for illegal or harmful purposes

8. Prohibited Conduct

You agree not to:

Use the Service for any illegal purpose
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers
Use automated systems to access the Service without permission
Attempt to reverse engineer any part of the Service
Share account credentials or allow others to use your account
Circumvent usage limits or security measures

9. Termination

9.1 By You

You may stop using the Service at any time. To delete your account, contact support@unlimitedpatterns.com.

9.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice, for any reason, including violation of these Terms.

9.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, timely, secure, or error-free
The results from using the Service will be accurate or reliable
Any errors in the Service will be corrected
AI-generated content will be original or non-infringing

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNLIMITED PATTERNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability to you for all claims shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Unlimited Patterns and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
